1. DEFINITION OF TERMS The term "EXCLUSIVE" means that the Original Lifetime Limited Warranty is made exclusively and specifically to the named homeowner(s) who is the original purchaser of the solid vinyl siding, soffit and/or solid vinyl accessory material. The term "LIFETIME" means the actual full lifetime period (i.e., until death) of the original homeowner/purchaser — but only if this purchaser remains as the owner and primary occupant of the residence on an uninterrupted basis. At such time that the original homeowner/purchaser should no longer be the primary full time resident — for any reason (but including (a) the sale of the residence to another party — or — (b) the designation of the residence as an investment or rental property) — then the warranty coverage is automatically converted to a new 60-year non-prorated Limited Warranty with a starting date of the original installation.
2. MANUFACTURING GUARANTEE These solid vinyl building products are manufactured using the finest raw materials, in conjunction with the highest quality workmanship and production techniques. The manufacturer warrants that the vinyl siding will not peel, blister, pit or corrode, as a result of manufacturing defects, or as a result of exposure to ocean air (salt spray). In addition, this solid vinyl siding is a nonconductor of electricity and does not interfere with radio or television signals. If any part or portion of the siding fails to perform as a result of manufacturing defects — the manufacturer warrants exclusively that the defect will be repaired or replaced (at manufacturer's option) - including cost of labor and material, not to exceed original purchase price.
3. HAIL DAMAGE This solid vinyl siding is extremely resilient and will resist damage caused by the impact of a normal hailstorm. Should damage occur as a result of a hailstorm, the manufacturer will provide replacement material for the siding that was damaged beyond that covered by the homeowner's insurance policy less the normal deductible. Proof of submission and resolution from the homeowner's insurance company are required before final settlement of the claim. The manufacturer will not be responsible for the cost of labor to replace hail-damaged material or for any related freight costs.
4. NORMAL WEATHERING Exposure to the elements can be expected to cause gradual and uniform color change (i.e. normal weathering). This can vary, depending on the geographical location and wall exposure. If the siding changes color in excess of 4 standard industry units during the lifetime the original homeowner owns and lives in the home, as determined by the manufacturer, the amount of weathering will be considered excessive, and the manufacturer will repair or replace, at its option the affected material. Any weathering change that occurs on a specific wall section in a manner that varies from panel to panel also will be considered a defect and will be covered under the terms and conditions of this warranty (checkerboard effect). Dark brown pigments are especially sensitive to exterior weathering and this color is not warranted for sidewall applications. It is normal for weathered material to have a slight unobjectionable shade difference underneath the butt (or shadow line) portion of the panel — as well as underneath protected eave and overhang areas. A defect will be remedied, at the manufacturer's option, by the repair or replacement of any affected panels. A color variance may also occur between any new replacement panels in comparison to the originally installed panels, due to weathering and would not be indicative of a defective siding. The terms of this coverage will commence on the date of the original installation, and continue in effect under terms of the original buyer's warranty, or transfer program if applicable.
5. WARRANTY AGAINST CHALKING Crane Sidings are produced with an exclusive VYCRALAR™ formulation, featuring treated Ti02, and are warranted not to chalk in an offensive manner that could cause discoloration of trim areas.
6. OBTAINING PERFORMANCE UNDER THIS WARRANTY PROGRAM Within a reasonable time after discovery of a suspected manufacturing defect, communicate with the installing contractor, briefly explaining your complaint. The contractor, after personal inspection, should register any complaint felt to be applicable under this warranty to the Customer Service Department, at the address listed on this warranty certificate. It is necessary to correctly identify the style of siding and, if possible, the manufacturing Batch Date Code. The contractor will be required to submit appropriate photos and/or samples showing the perceived defect. Upon receipt of this correspondence, the manufacturer will request any additional information, including any requirement for field inspection by a manufacturer's representative. The manufacturer is not the installing contractor, and does not warrant damage or defect caused by faulty installation. Proper installation is defined and outlined by many industry accepted publications. Faulty installation of this product renders all warranty coverage null and void. The manufacturer is not responsible for lack of performance in any way by the installing contractor. If the installing contractor is unavailable — and the buyer cannot communicate through the local or regional distributor — all correspondence should be directed to the Customer Service Department at the address listed below, along with appropriate photographs and/or samples. The manufacturer will require evidence of the date of installation at the time any remedy is sought. Accordingly, we request correct registration of the purchaser's identification card at the time of the original purchase. Any repair or replacement not pre-authorized shall release the manufacturer from all liabilities and obligations with respect to the products involved. The manufacturer reserves the right to discontinue or make changes in any of its products — including changes both in styles and colors — without liability to the original purchaser or future transferees of this warranty. In the event that such discontinuance or change should cause products covered by this warranty to be unavailable, the manufacturer shall have the right to substitute a product — or refund a proportionate cost of replacement — at their sole discretion. Return of the Original Purchaser/Homeowner Identification Card is not required as a condition to the manufacturer's performance. It is, however, the most convenient means of establishing proof of identity of the original purchaser/homeowner, and date of installation of the solid vinyl siding products — and the manufacturer requests that the Identification Card be completed and submitted at the time of installation.
7. TRANSFER OF WARRANTY Upon sale or transfer of the residence covered by this warranty, the new homeowner can receive limited warranty coverage up to a period of 60 years from the date of the original installation. Warranty coverage for color change discussed in section 4 is excluded from this transfer feature. This limited warranty coverage is also automatically available, in place of the original homeowner/purchaser coverage, to the original purchaser who becomes an absentee landlord and uses the property for rental purposes. This supplementary warranty shall be non-prorated from the date of the original installation. There is no subsequent warranty coverage for secondary (or future) transferees — including secondary purchasers of rental income property.
8. WARRANTY COVERAGE - NEW CONSTRUCTION INSTALLATIONS / COMMERCIAL INSTALLATIONS In the case of an installation of these materials on a newly constructed home - where the material is originally purchased by the builder the original homeowner's exclusive lifetime warranty coverage shall be designated and in force to the original buyer and occupant of the residence. This original buyer should properly register the warranty with the manufacturer. In the case of commercial installations - such as apartment buildings, condominiums, etc. — the warranty coverage shall be 60 years prorated. During the first five years after the date of the original installation of the products is completed, the manufacturer will, at its option, repair or replace the vinyl siding determined to be defective in accordance with the terms and conditions of this warranty at no cost to the property owner. During the sixth year after the date of the original installation, the manufacturer will bear ninety percent (90%) of the warranty obligation in accordance with the terms and condition of this warranty. Thereafter, during the seventh and each subsequent year through the twelfth year after the date of original installation of the products, the manufacturer's share of the warranty obligation will decrease by ten (10) percentage points each year until the thirteenth and fourteenth year where the manufacturer's obligation with be twenty (20) percent. During the fifteenth year after the original installation date, the manufacturer's share will decrease to ten percent (10%) and shall remain at that for the remaining forty-five (45) years of the sixty year limited warranty period. This coverage period shall not be extended by any warranty repairs or replacements.
9. CARE & MAINTENANCE Although this solid vinyl siding is made of premium, long-term, and durable materials — like anything else, it will perform best when it is kept clean of dirt or foreign matter buildup. Industrial fumes, airborne pollutants, mildew, or rust stains should be properly removed — often by a simple hosing down of the wall on a reasonably scheduled basis. If a homeowner neglects to keep the solid vinyl siding surface clean, and a harmful surface buildup is allowed to occur, restoration of the wall appearance to a fresh and clean condition can become a difficult task. In such cases it is specifically the homeowner's responsibility — and not the responsibility of either the manufacturer or the installing contractor — to restore the wall surface to a clean and fresh condition.
10. ITEMS NOT COVERED BY WARRANTY These warranties do not cover damage or defect caused by settlement or shifting of structural members or adjoining surfaces, structural defects of the building, fire, wind, flood, lightning or other acts of God (except those specifically warranted against in this warranty statement), intentional acts and unreasonable use, accident, negligence, exposure to harmful chemicals, pollutants, mildew — or airborne stains. The installation of accessory products — which are either inherently incompatible with the manufacturer's siding, or which are installed in a manner detrimental to the good performance of the solid vinyl siding — render this warranty null and void.
11. LIMITATIONS THERE ARE NO EXPRESS WARRANTIES EXCEPT AS CONTAINED IN THIS WARRANTY STATEMENT. ORAL STATEMENTS DO NOT CONSTITUTE WARRANTIES. THE MANUFACTURER'S LIABILITIES ARE LIMITED SOLELY AND EXCLUSIVELY TO THE OBLIGATIONS SPECIFICALLY UNDERTAKEN HEREIN AND (EXCEPT AND ONLY TO THE EXTENT THIS LIMITATION IS SPECIFICALLY PRECLUDED BY APPLICABLE LAW OF MANDATORY APPLICATION) DO NOT INCLUDE ANY LIABILITY FOR ANY INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES OF ANY KIND WHATSOEVER, WHETHER ANY CLAIM IS BASED UPON THEORIES OF CONTRACT, NEGLIGENCE, OR TORT. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations and exclusions may not apply to you. These warranties give you specific legal rights, and you may also have other rights which vary from state to state. NO EMPLOYEE, AGENT, OR OTHER PERSON IS AUTHORIZED BY THE MANUFACTURER TO ASSUME FOR IT ANY LIABILITY IN ADDITION TO THAT SET FORTH IN THIS WARRANTY STATEMENT.
